LAST WILL & TESTAMENT – sample 2
I, FLORA WING (NRIC NO: 611118-17-5284) of No. 97, Jalan 2/37B, Taman Maluri, 52111 Kuala Penyu hereby revoke all former wills and testamentary dispositions made by me and declare this to be my Last Will and Testament.
1. I APPOINT ANTHONY FAH (NRIC NO: 33333333) presently of Block J4-4-2, Taman Pandan, 88100 Kuala Lumpur (hereinafter referred to as ‘my Trustee”) to be the sole executor and trustee of this my Will but if he shall die in my life-time on or after my death without having proved this my Will then I hereby appoint LINDA WENG (NRIC NO: H099983618) of Block J, Desa tIGA, 88100 Kuala Penyu to be my sole executrix and trustee.
2. I DECLARE that the expression “my Trustee” shall men and include the trustee or trustees for the time being of this my Will, whether original or substitute and, if there shall be no such trustee shall (where the context so permits) include person or persons empowered by statute to exercise or perform any power or trust hereby or by statute conferred upon the trustee or trustees hereof and willing or bound to exercise or perform the same.
3. I BEQUEATH, DEVISE and GIVE all my shares rights and interests in all my immovable or movable properties of whatsoever nature or description and wheresoever situate now or hereafter acquired including but not limited to all my ready monies which are standing to my credit at any bank or financial institution and all my ready monies which I may be entitled to upon my death not hereby or by any codicil hereto specifically disposed off (including any property over which I may have general power of appointment or disposition by Will) including my monies under EPF No. 134444775721 to my Trustee UPON TRUST for the benefit of my daughter LAU LAU SAN (F) (No. Sijil Daftaran Anak: 06660042) (hereinafter referred to as my “Beneficiary”) to collect rent and income derived therefrom and to call in and convert the same into money with power to postpone the same calling in and conversion thereof for so long as he may think fit without being liable for loss.
4. My Trustee shall hold the monies to arise from the sale calling in and conversion and all my unsold property and all my ready monies referred to in Clause 3 above upon the following trust:-
a. upon trust to pay thereout all my just debts and funeral and testamentary expenses and legacies including any duty or tax payable in respect of my estate; and
b. subject to Clause 4(a) above UPON TRUST to give the residue to my Beneficiary absolutely.
5. Having addressed my mind to my husband PONY KONG (NRIC NO: 5888661443) I hereby state that I do not wish to bequeath anything to him.
